1. Acceptance of Terms

  • No Retention of Conversations: SpiritusGPT AI does not store, record, or retain any voice or text conversations. Once a session ends, all input and output data are deleted and not persisted in any form.

  • No Personal Data Collection: As the Service does not require account creation, no personal data (such as name, email, or other identifiers) is collected or stored, except as required for temporary processing during a session, which is immediately discarded thereafter.

  • Data Processing: Any data provided during a session is processed in real-time solely to generate responses and is not used for any other purpose, including analytics, training, or sharing with third parties.

4. User Responsibilities

  • Lawful Use: You agree to use the Service in compliance with all applicable laws and regulations. You must not use the Service for any illegal, harmful, or abusive activities.

  • Prohibited Activities: You are prohibited from:

    • Using the Service to infringe upon, misappropriate, or violate the rights of others, including intellectual property rights.

    • Attempting to reverse engineer, decompile, or uncover the source code, algorithms, or underlying technology of the Service.

    • Using the Service to generate or disseminate content that is defamatory, obscene, or otherwise objectionable.

    • Attempting to extract data programmatically or bypass any safety measures implemented by the Service.

  • Accuracy of Output: You acknowledge that the Service uses probabilistic AI models, and outputs may not always be accurate, complete, or reliable. You are responsible for verifying the accuracy of any information provided by the Service before relying on it.

5. Intellectual Property

  • Ownership: SpiritusGPT owns and retains all rights, title, and interest in the Service, including its software, algorithms, and underlying technology.

  • User License: You are granted a non-exclusive, non-transferable, revocable license to use the outputs generated by the Service for personal, non-commercial purposes, subject to these Terms.

  • User Content: As no conversation data is stored, you retain ownership of any input you provide during a session. Any output generated by the Service is provided under the license described above, and you may not claim ownership of the Service’s underlying technology or models.

  • Restrictions: You may not copy, modify, distribute, sell, or lease any part of the Service or its outputs for commercial purposes without prior written consent from SpiritusGPT.

6. Privacy

  • No Account Creation: The Service does not require or support account creation, ensuring no personal data is collected for account purposes.

  • Temporary Processing: Any input provided during a session is processed temporarily in memory to generate a response and is not stored or logged after the session ends.

  • Third-Party Sharing: No conversation data is shared with third parties, as it is not stored or retained.

7. Limitation of Liability

  • No Warranty: The Service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, reliability, or fitness for a particular purpose.

  • Liability Cap: To the fullest extent permitted by law, SpiritusGPT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. SpiritusGPT’s total liability shall not exceed the amount paid by you for the Service, which is zero as the Service is currently free.

  • Risk Acknowledgment: You use the Service at your own risk, acknowledging that outputs may contain inaccuracies or errors.

8. Indemnity

You agree to indemnify and hold SpiritusGPT, its affiliates, officers, and employees harmless from any claims, damages, or losses arising from your use of the Service, including any violation of these Terms or applicable laws.

9. Termination

  • Termination by User: You may stop using the Service at any time.

  • Termination by SpiritusGPT: We reserve the right to suspend or terminate access to the Service at our discretion, with or without notice, for any reason, including suspected violations of these Terms.

  • Effect of Termination: Upon termination, all rights to use the Service cease, but these Terms’ provisions regarding intellectual property, liability, and indemnity will survive.

10. Modifications to Terms

We may update these Terms from time to time. The updated Terms will be posted on our website with the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Francisco, California.
